German nationals were subject to Hague, not American, depositions

Medpointe Healthcare Inc. v. Apotex, Inc., et al., D. Del. No. 06-164-SLR, Jan. 26, 2007.

Robinson, J.  The court ordered depositions of German nationals by means of the Hague Convention.

The inventor, a former employee, and two non parties are German nationals and former employees of Plaintiff’s predecessor.  One witness had agreed to cooperate in an assignment agreement.  The witnesses agreed to Hague depositions.  The Court declined to order American depositions and ruled that the appropriate manner to depose these witnesses was through the Hague Evidence Convention.
