Thygne, J. Following a Markman hearing, the Court issued a decision on the disputed terms.
The patents-in-suit relate to beverage cans and the methods for joining the can ends to the can bodies. Plaintiff asserted claims under two patents, and defendant asserted counter claims under five patents. The Court conducted a Markman hearing on March 16, 2007. Subsequently, the parties submitted a stipulation identifying certain claim terms to which the parties agree as to the proper construction. The Court issued a Memorandum Order on the proper construction of 43 terms.
