This Court has no jurisdiction over German parent of Delaware subsidiaries
Farnan, J. Defendant’s motion to dismiss German parent corporation for lack of personal jurisdiction is granted.
This action alleges trade secret misappropriation and unjust enrichment. A motion to dismiss for improper service on the foreign defendant Siemens AG was cured by service pursuant to the Hague Convention and is now moot. Plaintiff made a prima facie case of personal jurisdiction and the Court permitted jurisdictional discovery. The Court now finds that insufficient facts have been alleged to establish that Siemens AG regularly does business in Delaware, engages in other persistent activities in this state, or derives substantial revenue form Delaware. There is no evidence of control of any of its Delaware subsidiaries.
