Court limits expert testimony in Daubert rulings

Robinson, J.  The Court grants two Daubert motions and denies third without prejudice.  Fourth Daubert motion is unopposed.

The technology relates to cellular telephone networks.  Plaintiff moved to exclude the invalidity testimony of Dr. David Goodman as unreliable.  The Court finds that this expert did not conduct a proper anticipation analysis in that he failed to construe the limitations in the prior art reference.  He further failed to characterize means-plus-function limitations through corresponding and equivalent structures.  His testimony will therefore be excluded.  Defendant’s motion to limit testimony of Dr. Oded Gottesman is granted in part.  His testimony will be limited to that offered pretrial.  He will be precluded from testifying about equivalents if defendant claims its product implements a “maximum likelihood” process.
