Patent is not unenforceable due to inequitable conduct

Sleet, C. J.  Findings of fact and conclusions of law.

A bench trial on the issue of inequitable conduct concerning a patent related to a “high efficiency switching regulator” was held June 2, 2009.  Defendant asserted that plaintiff selectively failed to disclose a material prior art reference to the patent office.  Following trial, the Court found that defendant did not establish “the type of ‘but-for’ materiality required under the Therasense standard.”
