Limited expedited discovery allowed in support of preliminary injunction

Kone Corporation v. Thyssenkrupp USA, Inc., et al., Civ. Action No. 11-465-LPS-CJB, September 26, 2011.

Burke, M. J.  Motion for leave to take expedited discovery granted in part.

Plaintiff Kone Corporation initiated this patent case on May 25, 2011, asserting that defendants Thyssenkrupps’ I.MOD Escalator Modernization System infringes U.S. Patent No. 6,685,002.  On September 2, 2011, plaintiff moved for leave to take expedited discovery in support its motion for preliminary injunction.  The motion was granted in part because plaintiff had shown a need for certain circumscribed subject-matter.  However, the discovery granted was narrowly tailored to address that need.
