Patent title passed on the date the state recognized the legal entity

Personalized User Model, L.L.P. v. Google, Inc., C. A. No. 09-525-LPS, September 13, 2012.

Stark, J.  Motion to dismiss denied.

Defendant moved to dismiss for lack of standing, asserting, inter alia, that the assignment was executed before the legal entity existed.  Motion was denied.  Entity held equitable title.  Legal title passed on date the state recognized the legal entity.  The assignment was subsequently ratified by virtue of recordation with the USPTO.
