Court does not strike potential fraud defense

Robinson, J.  Plaintiff’s motion to dismiss defendant’s counterclaims and to strike certain affirmative defenses was denied.  Defendant’s motion to amend its counterclaim was granted.  

Plaintiff moved to dismiss defendant’s counterclaims and to strike certain affirmative defenses.  The motion was denied.  The counterclaims provided sufficient notice to plaintiff on the issue of invalidity and the affirmative defenses are supported by facts.  Defendant’s motion for leave to amend its counterclaim to add more facts is granted.
