Plaintiff lacks an ownership interest in the patents to maintain suit

Robinson, J.  Defendants’ motion to dismiss for lack of standing is granted. 

Defendants moved to dismiss for lack of standing, asserting, inter alia, plaintiff transferred ownership of the patents-in-suit.  The motion was granted.  Plaintiff had previously entered into a settlement and license agreement with a related defendant.  Pursuant to the terms of that agreement, as construed by the court, plaintiff transferred ownership of patents-in-suit and, thereby, lacks standing.
